You acknowledge that each visit to this website is governed by the TOS in effect at the time of your visit, which we retain the right to amend at any time. Before utilising any of the services listed below, we ask that you carefully read this TOS. You agree to be bound by the terms of this TOS by using these services, and you acknowledge that you have read and understand them. Please leave this page and this website without accessing or using any of the services if you do not agree to be bound by these terms of service.
    “User” in these TOS refers to all authorised users of the Site, including guests, proprietors, and current and potential Q Graders.

    CQI and/or its affiliates control all rights to the pages on this website and any materials made available for download (together, the “Site”). Trademark and copyright laws, both domestically and internationally, safeguard this website. Without the full written consent of CQI, no part of the content on these pages may be reproduced, published, altered, or distributed in any way. This website is for your personal or business use only. You undertake to abide by all relevant end user licence agreements and maintain all proprietary notices, including copyright notices, on any downloaded content.

    Information We Receive

    Personal information: Upon registering on this website, you provide us your name, email address, gender, phone number, address, and additional details, based on the kind of user you are. We allow you to add more profile details throughout the registration process, like your title, place of employment, and the option to upload a photo of yourself or your company’s logo. At any moment, you can change the information on your profile by visiting your profile page and selecting “Edit My Profile.” Data will be updated right away. Send an email to info@caffeinization.com with your request to have your profile removed.

It is not required to subscribe to our newsletter service. Users have the option to unsubscribe from CQI’s email list at any time. Please go to your CQI profile, pick the Personal Information page, check the box next to “I would like to receive information through newsletters,” and click “Update” to accomplish this.

    Frequency

    The newsletter will be published every three months, and in addition, there will be sporadic emails and general updates.


    Limited Liability

    We exclusively retain the right, at any time and with or without prior notice to you, to alter or stop the newsletter. If we use this privilege, you and any other party won’t be held responsible.     User Conduct

    You acknowledge that all information, data, text, pictures, images, videos, messages, tags, and other materials (collectively, “Content”), whether uploaded to the internet or sent privately, are the exclusive property of the individual who originally created them. This implies that any Content that you upload, post, email, transmit, or otherwise make available via the Site is solely your responsibility and does not belong to CQI. Since CQI has no control over user-posted content on the site, it cannot ensure the veracity, accuracy, or quality of such content. You acknowledge that you might be exposed to offensive, indecent, false, or objectionable Content while using the Site.

    Any Content, including but not limited to mistakes or omissions, as well as any loss or damage of any kind resulting from the use of any Content posted, emailed, communicated, or otherwise made accessible over the Site, are not subject to CQI’s liability under any circumstances.     • Pretending to be someone else, such as a CQI staff member, forum leader, or host; fabricating headers or otherwise manipulating identifiers in order to conceal the source of any content transmitted through the site;
    • You may not upload, post, email, transmit, or otherwise make available any content that violates any law, contract, fiduciary relationship, or proprietary right (such as insider knowledge or confidential information disclosed in the course of employment relationships or under nondisclosure agreements);
    • You may upload, post, email, transmit, or otherwise make available any content that violates a third party’s patent, trademark, trade secret, copyright, or other proprietary rights;
    • Uploading, posting, emailing, transmitting, or making available in any other way any content that you are not authorised to make available under any law, contract, or fiduciary relationship (e.g., insider knowledge, proprietary and confidential information learned or disclosed during employment relationships, or under nondisclosure agreements);
    • Posting, emailing, transmitting, or making available in any other way any content that violates any patent, trademark, trade secret, copyright, or other proprietary rights of someone else;
    • Disregarding any applicable local, state, federal, or international law; giving material support or resources (or hiding or disguising the type, location, source, or ownership of such resources) to any organization(s) designated by the US government as foreign terrorist organisations in accordance with Section 219 of the Immigration and Nationality Act;
    • Harassing or “stalking” another individual; or creating multiple identities or profiles for the same person or entity.

    You consent to using the Site in a way that complies fully with your duties under other agreements, such as the Owner Terms and Conditions, Q Coffee Licencing Agreement, and In-Country Partner (ICP) Agreements, to CQI and other Users.

    You understand that CQI may or may not pre-screen Content and that, in their sole discretion, CQI and its designees will have the right (but not the duty) to do so. CQI and its designees shall have the right, without limiting the foregoing, to remove any Content that is objectionable or violates the TOS. You acknowledge that using any Content entails risks, including depending on its accuracy, completeness, or usefulness. As such, you must assess the risks involved and assume all of them. You understand that you cannot depend on any Content that CQI creates or submits to the Site in this regard.

    Indemnity

    Assuming full responsibility for any claim or demand, including reasonable attorneys’ fees, made by any third party resulting from Content you submit, post, transmit, modify, or otherwise make available through the Site, your use of the Site, your violation of the TOS, or your infringement on another person’s rights, you agree to indemnify and hold CQI and its subsidiaries, affiliates, officers, agents, employees, partners, and licensors harmless.

    Termination

    You acknowledge and agree that CQI may instantly cancel, restrict, or suspend your registration on the Site and your access to it without any previous notice. The following situations may result in termination, restriction of access, or suspension: (a) breaking the terms of service or other incorporated agreements or guidelines; (b) requests from law enforcement or other government agencies; (c) stopping use of the Site or making material changes to it; (d) unexpected technical or security issues or problems; (e) prolonged periods of inactivity; (f) engaging in fraudulent or illegal activities; and/or (g) failure to pay any fees that you owe CQI. Furthermore, you acknowledge that CQI retains the exclusive authority to terminate your registration or access to the Site, and that CQI will not be accountable to you or any third party for doing so. CQI will also make all terminations, access limitations, and suspensions for cause.

    Limitation of Liability

    You specifically acknowledge and agree that and its subsidiaries, affiliates, officers, employees, agents, partners, and licensors shall not be liable to you for any punitive, indirect, incidental, special, consequential, or exemplary damages, including, but not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses (even if cqi has been advised of the possibility of such damages). Resulting from:

    (a) The use or the inability to use the site;
    (b) The cost of procurement of substitute goods and services;
    (c) Unauthorised access to or alteration of your transmissions or data;
    (d) Statements or conduct of any third party on the site; or
    (e) Any other matter relating to the site(e) any other matter relating to the site.

    Choice of Law and Forum

    All claims, causes of action, or disputes (regardless of theory) arising out of or relating to the tos, or the relationship between you and cqi, shall be brought exclusively in the courts located in the county of los angeles, california, or the u.S. District court for the central district of california. You and cqi each agree that the tos and the relationship between us shall be governed by the laws of the state of california without regard to its conflict of law provisions. You and cqi consent to submit to the personal jurisdiction of the los angeles county courts.

    Clara, california, or the central district of california, and you thus consent to waive any and all objections to the appropriate courts’ venue and their ability to exercise jurisdiction over the parties.
